Italian Legislative Decree 231 / 2001

The Italian Legislative Decree 231 / 2001 introduced a set of rules based on the principle of administrative responsibility of bodies, including incorporated companies, stating that companies that are found liable may face penalties for crimes committed or attempted by directors or employees in the interest or to the advantage of the company. Any administrative breaches arising from criminal intent are subject to fines and, in the most serious cases, administrative sanctions.

The regulation states that a company cannot be held liable where it can show the following:
•It has adopted and effectively implemented an Organisational and Management Model designed to prevent this kind of crime
•It has appointed a Supervisory Body with independent powers, to monitor functioning and compliance of the model and handle any updates to it. 
Any breach of ethical standards and corporate policies can be communicated (anonymously if desired) to the relevant Supervisory Body (in Italian, the Organismo di Vigilanza or OdV) nominated by each company in the api group, detailed below:
